In accordance with the provisions of the Law No. 6698 on the Protection of Personal Data (“KVKK”) and the provisions of the European Union General Data Protection Regulation (GDPR), the joint practice/clinic operated by Dentist Gülşah Benkli and Orthodontist Assoc. Prof. Dr. Yasin Atakan Benkli, located at Kültür Mah. Talatpaşa Blv. Nazar Apt No: 23 İç kapı No: 3 Konak-İZMİR (hereinafter referred to as Physician/Doctor/Practice/Clinic/Employer), as the Data Controller, processes your personal information within the framework explained below; Your personal data will be recorded, stored, updated, disclosed to third parties where permitted by law, transferred, classified, and processed in the ways listed in the KVKK (Personal Data Protection Law) and GDPR (General Data Protection Regulation). We are informing you about our mutual rights and obligations under the aforementioned legal regulations.
In accordance with legal regulations, we will record and store your personal information in our archives to establish a Physician-Patient relationship and to provide you with healthcare services (diagnosis, treatment, care services, etc.) in line with patient benefit and public health. We are also obligated, under the Private Hospitals Law, Private Hospitals Regulation, Health Application Circular, Patient Rights Regulation, and other legislation, to record and store all necessary information such as identity, address, telephone, medical history, and other relevant details to identify the patient receiving healthcare services. We are also obligated to maintain all records and documents in electronic or paper format to serve as the basis for processing in the medical patient file. Furthermore, for public health and preventive medicine services, your personal data may be shared with relevant authorities and individuals upon request by the Turkish Ministry of Health, Provincial Health Directorates, Public Health Centers and other units affiliated with the Ministry of Health, the Social Security Institution, and your insurance company (if you use private health insurance), or by individuals appointed by these authorities, or through established e-health systems and similar platforms, or within the scope of our notification and/or reporting obligations. We inform you that this information will be shared.
PURPOSES, METHODS OF COLLECTION, AND LEGAL GROUNDS FOR PROCESSING PERSONAL DATA
Your personal data is processed for the following purposes: establishing and fulfilling the Physician-Patient relationship and the terms of the contract; using it in the services we can provide to you; recording identity, address, tax number, and other necessary information, including personal health data, to identify the person performing/requesting the transaction; preparing all records and documents that will serve as the basis for processing in electronic (internet/mobile, etc.) or paper format; complying with information retention, reporting, and notification obligations stipulated by legislation, authorized institutions, and other authorities; marketing and statistical activities to improve service quality; providing requested/other products/services; and your special categories of personal data are processed due to communication, information provision, and similar processes within the contractual relationship.
Your blood type, laboratory and imaging results, test results, allergies, chronic diseases, sexually transmitted diseases, infectious diseases, data regarding previous surgeries/operations, e-health information, medications you regularly use, information regarding Covid-19, medical treatments, prescription information, harmful habits, body analysis and measurement information, and other health data and personal data necessary for the treatment and procedures to be applied to you; To create patient files, conduct preventive medicine, examinations, medical diagnoses, treatments and care services, perform follow-ups after medical diagnosis and treatment processes, manage potential complications, communicate directly with you, manage appointment processes, manage patient satisfaction and requests, fulfill legal and contractual obligations, maintain your health data required by relevant legislation for specified periods, obtain consultation services from other relevant specialists when necessary to ensure your treatment is carried out correctly, fulfill legal obligations in accordance with the legislation within the scope of health tourism, plan transfer, accommodation, and interpreter services for patients/clients coming within the framework of health tourism, announce innovations related to medical treatments and practices, inform third parties about the medical procedure performed, plan and manage health services and their financing, ensure workplace safety, fulfill responsibilities arising from the legal relationship established between doctor and patient, and fulfill financial and administrative obligations.
